HISTORY OF THE CASE

This case was initially filed in on April 4, 2013 but remained "stayed" or on hold until 2018 while a similar case against the Wynn and Encore casinos in Las Vegas, Nevada made its way through the federal appeals process.  Ultimately, the Ninth Circuit Court of Appeals ruled in favor of the dealers in the Wynn lawsuit, and overturned the dismissal of that case.  That ruling directly impacted our case against the Riverside and allowed our case to proceed forward in the Court.

WHAT IS THE LAWSUIT ABOUT?

The Riverside casino operates a tip-pooling policy that allows supervisors to collect tips that are earned by the dealers.  We believe federal law prohibits that forced sharing of tips by the dealers with their supervisors.  This lawsuit seeks to recover the tips that were taken from the dealers and shared with their supervisors.  This lawsuit covers the time period of May 5, 2011 (which is the date the law was enacted) through the present.  

PARTICIPATING IN THE LAWSUIT

If you wish to assert a claim to recover tips that were taken from you during your employment at the Riverside, you can only do so by joining this case or filing your own lawsuit.  If you do not "act" by either joining this case or filing your own suit, you will not stand to collect anything that may be owed to you.  Please check the NEWS AND UPDATES section of this website for information on how to join the lawsuit.  You can also contact our office using the form below to discuss this further.
